1. ACCEPTANCE OF TERMS
By accessing or using the ITSVA platform (“Platform”), you agree to be bound by these Terms of Service (“Terms”).
If you do not agree, you may not use the Platform.
2. PLATFORM ROLE
ITSVA is a technology platform and food distribution marketplace that connects customers with independent, licensed food vendors.
ITSVA:
- Does NOT directly prepare food
- Does NOT act as the food manufacturer
- Does NOT control food production
Certain meals may be marketed under the ITSVA brand or as “ITSVA Curated Meals.”
All such meals are prepared by independent third-party vendors.
ITSVA provides branding, packaging, and distribution services only.
3. ORDERS & AVAILABILITY
- All orders are subject to availability
- Menu items may change without notice
- ITSVA reserves the right to cancel or modify orders at any time
4. PAYMENT TERMS
All payments are securely processed through third-party providers such as Stripe.
By placing an order, you agree to:
- Pay the full listed price
- Pay all applicable fees (delivery, service, taxes)
All payments are final unless otherwise stated.
5. REFUNDS & DISPUTES
Refunds may be issued at ITSVA’s sole discretion in cases including:
- Missing items
- Incorrect orders
- Significant quality issues
Refunds will NOT be issued for:
- Personal taste preferences
- Minor variations in food
ITSVA reserves the right to determine refund eligibility.
6. DELIVERY TERMS
- Delivery times are estimates only
- Delays may occur due to traffic, weather, or vendor issues
ITSVA is not liable for delays unless caused by gross negligence.
7. FOOD SAFETY DISCLAIMER
All food is prepared by independent vendors.
ITSVA does not guarantee:
- Food safety
- Food quality
- Ingredient accuracy
Customers consume food at their own risk.
8. ALLERGEN WARNING
Food may contain or come into contact with:
- Nuts
- Dairy
- Seafood
- Gluten
- Other allergens
ITSVA is not responsible for allergic reactions.
Customers are responsible for verifying ingredients before ordering.
9. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
ITSVA shall not be liable for:
- Foodborne illness
- Allergic reactions
- Health-related damages
- Indirect or consequential damages
ITSVA’s total liability shall not exceed the amount paid for the order.
10. THIRD-PARTY VENDOR LIABILITY
All liability related to food preparation rests solely with the vendor.
Any claims regarding:
- Food safety
- Illness
- Contamination
Should be directed to the vendor.
11. USER CONDUCT
You agree not to:
- Abuse the Platform
- Submit fraudulent claims
- Misuse refund policies
ITSVA reserves the right to suspend or terminate accounts.
12. ACCOUNT RESPONSIBILITY
Users are responsible for:
- Maintaining account security
- Providing accurate information
13. MODIFICATIONS
ITSVA may update these Terms at any time.
Continued use of the Platform constitutes acceptance.
14. GOVERNING LAW
These Terms shall be governed by the laws of the State of California.
